It's been over six years since I took the reins from Peter Capps, who had decked the halls of our magazine with remarkable growth and community spirit. Our roots in Holmes Chapel run deep, having lived here for over a decade. Watching the village transform into a winter wonderland year after year has only deepened my love for our cosy corner of the world. The festive season always brings with it the much-anticipated village fair, a time when we join hands with the partnership to jingle all the way, spreading cheer about this spectacular event. Our centre pages are stuffed like stockings with details about participating businesses and stallholders, complete with a handy map that guides you through our winter maze, ensuring you don't miss out on any of the yuletide fun. It's heartwarming to see our local bars and venues sprinkle their own brand of Christmas magic with festive drinks and treats.A special shout-out to Gail from the Holmes Chapel Partnership, who's been our Santa's little helper in assembling the centre pages. Her dedication and elf-like efficiency deserve the brightest of spotlights this holiday season.I would like to wish all our reader, writers and businesses a very happy Christmas!Business InsightsScan to Listen & Subscribearchpublications.com/podcastArch Publications Charity Partner 2023/24 Remember to tell our advertisers you found them in The Villages Mag!

8Patient Participation GroupTHERE been lots of progress at the Health Centre these past few months. Central to this is the addition of new staff members in reception and the dispensary. These new additions have enabled centre management to concentrate on improving the service levels, that have been reflected in a significant drop in complaints to the practise against the same time last year. This is great news for us patients, and reflects the hard work put in by all the team at the surgery.Winter demand preparation is ongoing, and having pretty much completed the winter flu vaccination programme, the surgery has given 2900 flu vaccines to the over 65’s, and 745 to those who are vulnerable and under 65. As we go further into one of the busiest times of the year for the NHS, it’s critical that we as patients continue to use the AccuRX triage system. Even though demand for appointments and healthcare is increasing, the system is allowing patients to receive the right care in a timely manner. It’s also a more private method of communicating with the surgery, however, as has always been the case, if you are unable to use the online system, and you have nobody who can help you fill it in, the reception team will help you complete the form. If your issues are particularly sensitive, then a private room is available if needed.Last issue, you may recall that the surgery has been talking with the other practises in the Congleton area about the provision of a same day access hub. This is to facilitate extra care services for specific health needs, and was to be based at the Memorial Hospital in Congleton. Significant progress has been made, but it has also been recognised that hosting it in Congleton presents issues for patients served by the London Road Health Centre. While the details are still to be worked out, the aim is for some of these services to be provided here in the village, eliminating the need for a significantly longer journey. Finally, the PPG has said its huge thank you‘s to a couple of panel members who have decided to step down after many years of support. This means we have a number of vacancies on the panel, so if anyone would like to give a little bit of time and help the surgery to improve their services, we’d love to have you join us. Please mail HCHCPPG@gmail.com and we’ll send out a panel form.Rich JepsonHolmes Chapel Health Centre PPG

16Eco tips for Christmas...IT’S CHRIIISSSTMAAASSSS!! I love nothing more than the joy of watching the kids get everything set for Santa and his reindeer, carols and (too much!) mulled wine in the village, turkey roast with Yorkshire puddings and sharing gifts with family. But there’s absolutely no doubt that Christmas can, if you let it, bring stress, financial strain, over consumption and waste, lots of waste! So this month I’m offering a few suggestions for a Christmas which has a reduced impact on the environment whilst not diminishing your merriment! ALL WE NEED IS LESS – Do we really need to buy so many gifts? Would our loved ones prefer the gift of making plans to spend time together over lunch, a voucher for a new experience or a contribution to a charity close to their hearts rather than that £20 gift set from M&S or festive food hamper covered in plastic?ALL WRAPPED UP – Rolls and rolls of plastic coated, glittery wrapping paper sealed using Sellotape and finished off with twirled ribbon and fancy labels. Sound familiar? It’s expensive and none of it can be recycled. How about opting for a mix of brown and red plain wrapping paper sealed with plastic free tape and basic tags attached with twine. Looks fab under the tree and all (except the twine) can safely go into your recycling.PRELOVED JOY – Why not gift pre-loved goods? We need to get over the view that everything needs to be brand new and teach our kids that re-using is perfectly normal and that a second hand book or toy brings just as much joy as a brand new one (unless it’s a half used colouring book I guess!!)DON’T GO CRACKERS! – It’s not a competition! Friends and family don’t come to visit to inspect how well you’ve decorated your house or dressed the dinner table so why not keep it simple? Christmas crackers are brilliant fun but try and buy ones that are 100% recyclable and defo avoid those with plastic tat inside.GO LOCAL – Can you get organised and leave yourself time to shop for food at one of our lovely local farm shops, do some of your gift buying at the Holmes Chapel Christmas Market on Sunday 3rd December or gift vouchers for use in local shops?OK, I’m done! I’ll get back in my box now!! Happy Christmas!Sam, Fillarup Holmes Chapel

20Our local heritage...THE evergreen Christmas tree is a central part of the Christmas celebrations, and decorated trees are everywhere - in public spaces, churches and homes. This custom was introduced to Britain by Prince Albert, husband of Queen Victoria, from his German homeland, but its origins there are much earlier. Saint Boniface, an 8th century Christian missionary, saved a child from pagan sacrifice on an oak tree by chopping down the tree. The fir which sprang up in its place was symbolic of the Christian faith and came to be associated with Christ’s birth. The German religious reformer Martin Luther was said to have put candles on a fir tree at Christmas to represent Heaven lit by starlight, and by the early 17th century there were reports of trees in Strasbourg being decorated with coloured paper, foil, sweets and fruit. All of these are reasons for good cheer and the fragrance is a reminder that nature will spring into fresh life before too long.Other evergreens, venerated in pagan times at winter festivals such as the Roman Saturnalia, were adopted by Christianity but with more appropriate meanings. For example holly, with its sharp leaves and red berries, represents the crown of thorns worn by Jesus during His crucifixion, and the red berries His blood. Some old churchyards (but not, alas, Holmes Chapel) have the thorn tree Crataegus monogyna growing within the walls. This is the Glastonbury Thorn, which is said to have sprouted from the staff of Joseph of Arimathaea (who provided the tomb for the body of Christ) when he came to England and which continues to flower on Christmas Day, a sign of new hope. Some examples are certainly very old, and may be cuttings from the original in Somerset. Holly, ivy, bay, fir branches and pine cones are used to deck the halls, but there is one evergreen which is never used in churches because of its use in the pagan ceremonies of the Druids, This is, of course, mistletoe, which they used in rites of human sacrifice and fertility. The custom of kissing underneath the mistletoe is probably a survivor of the latter.More wholesome is the practice of wassailing apple trees at New Year. This involved rituals to encourage the trees to crop well in the following year. Customs varied around the country, but most involved songs, processions and drinking cider from large bowls decorated with ribbons and greenery. The greeting “Wassail!” is an Anglo-Saxon toast meaning “Be whole!”, and the correct response is “Drink Hail!”, meaning “Good health!”. May we wish the same to everyone who reads this article during this festive season.Holmes Chapel U3A Local History Group

242HC Partnership news...SUNDAY, the 3rd of December sees the return of the Homes Chapel Christmas Market and Fair. Our centrefold pull-out guide includes all the highlights of the year, plus a handy map to take with you on the evening. If you don’t want to carry the paper map with you simply scan the QR code to access a copy of the map on your phone. This much-loved event is returning this year thanks to the determination and hard work of the Holmes Chapel Partnership. They have been working tirelessly since the summer to ensure that this year’s market is bigger and better than before! The main road through the village (The Square) will be closed to traffic from Costa down to and including Parkway, from midday until 10:00 pm on Sunday. It will be brought to life with 40 festive stalls starting at 3:00 pm until 7:00 pm. A further 10 stalls are located inside the Scout Hall. Additionally, many of our local shops and businesses will be open for you to buy gifts, or simply to be part of the Christmas festivities, so look at the map to see what’s on offer. The fairground returns to the Tesco car park, with a choice of six rides, Hook a Duck, and candy floss stall.Festival performances from the Hermitage Primary School Choir, Holmes Chapel Primary School Choir, Laura Wilson School of Dance, and the Lions Youth Brass Band will take place on the stage from 4:00 pm. Santa Claus will also be in attendance on his sleigh to meet the children near the entrance to Tesco.Always a popular event for meeting up with friends and family, the Christmas Market and Fair also offers plenty of delicious food and drink opportunities inside and out, which are listed in the pull-out guide. Refreshment stalls can be found along Parkway, inside St Luke’s Church Hall, together with a warm welcome from village pubs and eateries which are open for visitors. This is an entirely not-for-profit event, which would not have been possible without the generous sponsorships provided by Holmes Chapel Parish Council, Massey Feeds, Dutton Builders Merchants, Hurstwood Holdings, Bayfields Opticians & Audiologists, Joe White Fun Fairs, Sibelco, Laura Wilson School of Dance, The Village Mag, and Top-Secret Furniture. Thank you all for supporting this community event. I would also like to thank The Old Red Lion, Steven Docker and Tesco/St Luke’s Church Hall for the use of the car parks. And finally, new for this year, is our Holmes Chapel Partnership Christmas Draw which will be launched at the Christmas Market, with a first prize of £250, second prize of £100 and third prize of £50. 28Winter plants with Brian Lowe...AS the seasons shift, the promise of shorter days and longer nights looms. But fear not, for there are ways to keep our homes vibrant and lively, even as winter takes hold. To uncover the secrets of winter gardening, I met with Brian Lowe at Sparks Lane Nurseries, a master of creating stunning floral displays that defy the dreariness of the colder months.Brian, amidst crafting vibrant tubs and hanging baskets destined for local establishments, greets me with a flourish of garden gloves. His creations, a symphony of colours and textures, are not just displays but stories told through petals and leaves. He introduces me to a selection of plants and flowers specifically chosen for their frost resilience. Our first stop is the winter heather, or Erica carnea. This modest evergreen shrub, brimming with small but vivid flowers ranging from whites and pinks to reds, purples, and golds, is a testament to the adage ‘strength in numbers’. Its petite blossoms en masse create a lively tapestry in gardens. Growing up to 50 cm, winter heather is versatile, thriving in beds, containers, and baskets, continuing its vibrant display until April.Next, Brian highlights the unsung heroes of winter hanging baskets: pansies and violas. These hardy blooms are perfect for the cold, offering a spectrum of colours from deep purples and blues to vibrant yellows and oranges. They stand resilient against frost and light snow, always eager to greet the winter sun. Their compact and bushy nature makes them ideal for hanging baskets, where they create a lush, overflowing effect with minimal maintenance. Regular deadheading and ensuring moist soil are all they ask for.Beyond their aesthetic appeal, pansies and violas also support winter-active pollinators, providing a habitat and food source. Their presence in your garden is not just a visual treat but also an ecological boon, reminding us of nature’s resilience. Finally, Brian shares his secret touch in creating his renowned baskets: a mix of ornamental grasses. These add an extra layer of texture and a splash of contrasting colour, elevating his designs to more than just floral arrangements but pieces of living art.As I leave Sparks Lane Nurseries, I’m inspired by Brian’s passion and expertise. His winter displays are more than just decorations; they’re beacons of life and colour, brightening the darkest of winter days.Katy

32HELLO, and welcome to what will be the last issue for 2023... and hasn’t this year just flown by. It doesn’t seem 5 minutes since I was in the midst of preparing the bars for the festive madness yet here we are again, 12 months later.Hospitality this year has been a right old mixed bag. If you can allow me to generalise for the whole industry, we’ve seen a return to normality and pre-covid times from some people, we’ve also noticed more people go out less often or don’t stay out as long. The number of breweries, bars and restaurants closing continues to surprise, with the first half of the year showing some particularly bad numbers. It’s hard work in hospitality just now, so the Christmas peak can’t come soon enough for lots in the industry. We’ve seen it here in Holmes Chapel, with the much loved Swan reopening, and then sadly closing months later... yet the flip side of that in Sandbach, sees the Ringers on Welles St on the cusp of reopening back up as the Welles Cross. Great news! Knowing what’s been planned for the next couple of weeks running up to the big Ho Ho Ho, I think we’re all going to be full of Christmas cheer again this year. There are lots of markets where we can eat drink and be merry. A lot of venues have special events and evenings planned, from wreath making to brewery tasting nights, Christmas-themed drag artists to brass bands. It’s going to be a cracking end to the year.I’ll leave you with a little festive recipe, one for a homemade gingerbread syrup. This warming sweet syrup is a great little addition to your fridge and can be added to all sorts of drinks and treats to give them a little Christmas kick. Put 3 sticks of cinnamon and a tablespoon of allspice in a dry pan and toast for 2-3 mins on a medium heat until they’re nice and fragrant. Add 1.5” ginger root cut into big chunks, 150g of brown sugar and 200ml of water to the pan turning the heat down. Simmer for 18-20 mins until it’s thickened and all the sugar’s dissolved. Strain into a sterilised jar, and leave in the fridge when cooled. Add this to a hot chocolate, a milky coffee or make a rather naughty Christmas martini by adding a shot of syrup to a double vodka and some single cream or Bailey’s! Shake over ice, and pour into a martini glass with a glace cherry on top! One very Merry Christmas coming up! Rich, The Beer Emporium Bottle BankFrom the bar, with Rich

CW4 7AZ01477 533 934 | 07484 904 899clerk@holmeschapelparishcouncil.gov.uk | www.holmeschapelparishcouncil.gov.ukClose Pass Operation RESIDENTS have raised concerns over the safety of cycling around the village of Holmes Chapel and have shared those with the Parish Council, in particular our Village Infrastructure Committee. The Parish Council wrote to the Police and Crimes Commissioner, sharing videos received of cyclists facing near misses when cycling around the village. As a result, Cheshire Police organised a Close Pass Operation on the morning of 8th November. The aim was to raise awareness and educate drivers on how much space should be left when overtaking a cyclist and how to overtake them safely. A plain clothed officer cycled around the village with a radio and video equipment, supported by officers. Drivers who passed too close were then spoken to by the police. The operation was successful with 20 drivers being advised during the two hour operation and one person arrested for drug driving. This operation was supported by colleagues from the Cheshire Fire Services. The Parish Council is grateful to the Police and Fire Services for carrying out this operation after listening to the concerns of our residents.4 Year Manifesto 2023-27ON 31 August 2023, Holmes Chapel Parish Council agreed to select five projects/ commitments that we would endeavour to achieve during the current Civic Term 2023-2027. Days Out & Meals Out reviews...AFTER flicking through the fantastic The Villages Mag last month, I saw Plumleys advert and it reminded me that I hadn’t been for a while so I headed over to Plumleys for a look around their garden centre and to treat my mum to a yummy lunch.Plumleys is a family business located just outside the beautiful town of Knutsford. Owned & run by Gold RHS winning designer Andrew Yates & his wife Eloise. The garden centre is the home of a fantastic, large plant nursery selling everything you could ever need for your garden. Outside, there are bedding & pot plants, fruit trees, herbs, planters & pots galore. Inside ,there are all the tools you would need to tend to your garden, whether it’s a new trowel or spade you’re looking for or some cute signs to label up your seedlings. The friendly, knowledgeable staff are on hand to help & advise should you require.Inside the shop we also had a good look around all the lovely home accessories and gifts they had on offer, it was a treasure trove of lovely items by the make of Gisela Graham plus many other gorgeously made items. They had a beautiful display of autumn and Christmas items in stock. There was plenty of choice of house plants, too, ranging from big palms to the cutest cactuses.Walking through the shop, you will soon get to the Cafe at Plumleys. This cafe has cosy indoor seating with a real log fire set in the middle. On warmer days, you can sit outside, which is in a large poly tunnel, so still protected from the rain. It’s a great menu, offering lots of choices. Including breakfasts, sandwiches & toasties but not just your standard fillings, I spotted a chicken, bacon & egg club! Plus their ever popular burgers and lovely warming meals like Bourguignon Pie and loaded fries. My mum ordered their quiche, which was salmon and dill, served with roasted new potatoes and creamed leeks. And on a day when it was cold and wet outside, this meal was seriously tasty comfort food.I went for Plumleys Welsh Rarebit. Granary toast loaded with Black Sheep Ale rarebit sauce topped with streaky bacon. The cake counter was rather tempting with treacle tarts, a white chocolate, almond and blueberry cheesecake & slices of school chocolate crunch. The Cafe at Plumleys was in the list of top ten cafés and coffee shops in Mid Cheshire in the Northwich Guardian in August & I can totally tell why.Obviously, I will be heading back soon, just so i can try out another yummy lunch from their menu...Jenny, Days Out and Meals Out Reviews Garden Centre, Home & Gift Shop and Cafe at Plumleys serving gorgeous food.Open Mon – Sat 9:30 – 4:30. 52Community matters... A Lench charity golf daAN Unforgettable Day with A Lench Building Contractors: Golf, Charity, and Community**As the season turns, A Lench Building Contractors marks it with their anticipated annual golf day. A tradition that brings together staff and clients to rally behind a worthy cause. This year, our venue was the splendid Carden Park Hotel. I must admit, golf isn’t my forte, but the significance of being part of this event was undeniable. This year’s charity was Prostate Cancer UK, a cause close to their hearts. In 2022 they lost a member of their team Peter Martin, who was Health and Safety manager, to the disease. For Adrian, the company’s director, Peter wasn’t just an employee, but a close friend. Our eventful day started at the Club House, complete with a breakfast of bacon sandwiches. Here, I had the privilege of chatting with Adrian Lench, who shed light on the core objectives of their initiative – strengthening client relationships, raising funds, and driving awareness for their chosen charity. Their business, multi-dimensional in its approach, engages with developers like David Wilson Homes, Redrow, and Jones Homes, overseeing projects from inception to completion. In addition, A Lench has carved a niche in domestic services through a branch of the business called TTL. From extensions, loft conversions, to comprehensive home renovations, TTL’s breadth is impressive. A Lench’s extensive capabilities significantly bolster these home projects, with an edge in material procurement and a skilled team that ensures smooth project progression.Another part of the business is Wild Goose Architecture, steered by the seasoned Architectural Designer, Chris Rye. With over three decades under his belt, Chris’s involvement adds immense value. He collaborates closely with the construction team, ensuring client visions come to life perfectly. The golf day saw many familiar faces, long-standing clients, and suppliers of A Lench. Their conversations echoed a deep respect for Adrian and his team. The overwhelming number of hole sponsors, the generous monetary contributions, and the auction items bore witness to the community’s trust in A Lench. As the golfing began, we made our way to hole 17, the starting point for the day. We cheered and supported players with refreshments as they traversed the course. The day’s mood remained buoyant despite the weather’s minor hiccups. A memorable moment was the appearance of former footballer Matt Le Tissier at hole 17. A veteran with eight England caps and 161 goals for Southampton FC, he was there, supporting A Lench in their charitable endeavours.Post-golf, The Shooting Lodge at

The night featured a charity auction filled with sports memorabilia, a sumptuous BBQ, and Matt Le Tissier captivating us with tales from his footballing days. Despite my limited football knowledge and golfing skills, I was thoroughly entertained, a testament to the engaging nature of the day and its participants. As the day wrapped up, the collective efforts culminated in raising £12,500 for Prostate Cancer UK. These funds play a pivotal role in advancing research aimed at curtailing the fatality rate of prostate cancer. Prostate Cancer UK is committed to discovering enhanced treatments and early detection tests that can be pivotal in a screening process, potentially saving countless lives. What became strikingly apparent throughout the golf day was the profound bond shared within the A Lench community. Beyond professional affiliations, there exists a familial connection. The depth of their relationship was truly illuminated by their collective commitment to honouring the memory of Peter Martin. It’s a testament to their belief that Peter’s legacy can drive a brighter future, aiding countless men and their families in their battle against prostate cancer.Katy

60Sale of PoppiesIn the build up to Remembrance day we saw a team of our 6th formers touring around tutor groups selling poppies on behalf of Remembrance Day and the Royal British Legion. Last year, we set a record for the school last year so the team has a big target to aim for. On Sunday 12th, students from the school took part in the Holmes Chapel Village Remembrance Parade and Service. Many did so through local organisations like the Guides and Scouts but this year we were also represented by members of the Parish Youth Council and the Sixth Form.Bugsy MaloneWith two final weeks until show time, the cast, band, set designers and back stage crew of ‘Bugsy Malone’ have been working exceptionally hard to rehearse final scenes. Please show your support of all students involved by collecting a letter for tickets from the Arts Faculty office, payable by cash or cheque only. Tickets will be released the week prior to the show which is the 21st-23rd of November.Options Evening November 2023During the evening of the 9th November we welcomed year 9 students and their families into our school to kick off the options programme for 23-24. It was a fantastic evening where we all felt proud to be part of this community. Our staff were informative and supportive, helping the students in making these important decisions. Our older students did an incredible job of not only representing the subjects and our school but genuinely helped a lot of our year 9 students with their questions and prompted them to consider things they previously hadn’t. The families who came along were positive and excited about this next step for their child’s education, asking the right questions, looking for the information to help confirm their choices and were also open minded, using the opportunity to consider subjects that were new to them. Our VTQ offer this year is fantastic and was really well received by families. Some students left the event having confirmed their choices for GCSE and some students finished the night with lots more information and questions to consider over the next few weeks. We couldn’t have asked for more from the evening so thank you to all those involved, especially to the families who came along. On a personal note, I want to say how much I enjoyed meeting parents and carers last night and getting to know more of you; it was a pleasure to talk about your children’s education and to be part of this journey with you. Mike Forsyth - Progress Leader.Sixth Form Experience DaysOn the 31st October and 1st of November we held our Sixth Form Experience Days The vast majority of students from Year 11 attended one of these two days. Over the course of the days students gained first hand experience of what it is like to be a Sixth Form student. Students attended a timetable of chosen Sixth Form lessons, giving them the opportunity to try new subjects. They also had the chance to use all of the great facilities in the Sixth Form including the bespoke and purpose built social and study spaces. The response from the Year 11 students was excellent. They took full use of the opportunities available to themselves. Their engagement and positivity was excellent to see.In addition to this some of Year 11 students, who are hoping to attend a Vocational College, spent the morning with our Careers Adviser Mrs Jackson along with visitors from local Colleges. They had the opportunity to really focus on ensuring that they are prepared to apply to begin such courses suited to their aspirations and goals. It was wonderful to spend this time in the College with our upcoming intake. We hope that it has helped our Year 11 students to solidify their future option choices. Holmes Chapel Comprehensive SchoolHCCS update...

62Unwind with evening reection...AS the day draws to a close, before it’s time to recharge your mental and physical batteries, there’s a quiet opportunity to pause and find solace in reflecting on the events that have passed. Evening journalling serves as a bridge between the day’s activities and the calmness of the night. Dedicating a few moments to put pen to paper can reduce the impact of daily stresses, release emotional tension and pave the way for restful sleep.Journalling for Relaxation and Peaceful Slumber - Evening reflection journalling involves revisiting the day’s events, emotions and interactions. It’s a quiet ritual that allows you to decompress, process your thoughts and put closure to the day. Your words can take on any thought or topic, including gratitude, acknowledging challenges, celebrating successes or setting intentions for the following day.The purpose of an evening reflection is to empty your head of the mental baggage accumulated since you woke. Niggling thoughts can often take up residence, preventing us from winding down sufficiently, causing broken sleep and impacting how we feel the following morning.Using a journal as an outlet to transfer emotions and clear your head protects it from launching into overdrive at the most inappropriate time. Evenings also offer unobtrusive time to relish the joys experienced throughout the day. Keeping a record of what you’ve accomplished, learned and overcome is a great way to stay motivated and positive long-term.The Benefits of Reflecting in the Evening • Stress Reduction: reflecting on the day’s events and expressing thoughts on paper helps release built-up stress and tension.• Enhanced Sleep Quality: unburdening your mind creates an environment favourable for restful, revitalising sleep.• Mindfulness and Self-Awareness: paying attention to your thoughts and feelings enhances self-awareness and promotes mindfulness.• Gratitude: expressing gratitude for the positive moments and people in your day encourages an enhanced outlook.• Setting Intentions: reflecting on experiences allows you to set intentions for the next day, giving you a sense of purpose and direction.A Reflection Exercise - Before retiring for the night, find a cosy, quiet space to journal. Reflect on your day and write down what brought you joy, what tested you and what you’re looking forward to tomorrow. There is no time limit. Compose for as long as you feel called to.Over time, you may notice patterns emerging in what pleases you and causes tension. Spotting these patterns allows you to act differently and improve outcomes. Each entry is an act of self-compassion and a reminder that you deserve a moment of stillness amid life’s hustles.Next month, we’ll look at the benefits of bullet journalling for business and personal wellbeing..Anna WoolliscroftYou can find me on Instagram, TikTok or Facebook: @JournallingWithAnna

66Let’s talk legal...THE dangers of getting divorced before you reach a financial settlement. If you decide to separate from your husband or wife, it isn’t uncommon to want to start divorce proceedings quickly so you can move on to the next chapter of your life, and so that you can achieve a final and binding financial settlement. However, if you talk to a divorce solicitor at Evolve Family Law, we will normally recommend that you don’t finalise your divorce until you have reached a financial settlement and you have secured a financial court order. This advice (and your decision not to finish the divorce until there is a financial order) is best taken before any divorce proceedings are even started, because it may affect who starts the divorce proceedings, and how they are started. This advice doesn’t mean that you can’t apply for a divorce. Instead, you should delay applying for the final order of divorce.Dangers of a divorce without a financial settlement and financial court order. Although you may think that the dangers of getting divorced without first reaching a financial settlement or securing a financial court order are remote, they could create significant difficulties for you.One risk is that your ex-spouse may pass away before you obtain a financial court order. This could be a major problem for you if most of the family assets are owned in their sole name, or if they have significant pensions, or if they are financially supporting you. The risks are:1. If your ex-spouse left provision for you in a Will made during your marriage their gift is invalid because of the final order of divorce2. If your ex-spouse died without making a Will (called intestacy) you will not inherit their estate under intestacy rules because you are no longer classed as their next of kin3. Whilst you may be able to bring a claim for financial provision against your ex-spouse’s estate the application could be opposed by the beneficiaries in the Will or the next of kin under the intestacy rules. Your claim would also be lower because you are no longer classed as a widow or widower4. If your ex-spouse had a pension you will not be entitled to the widow or widower’s pensionObtaining a financial court order. A financial court order can be obtained by agreement once you have secured your conditional order of divorce. Evolve can help you negotiate a financial settlement and apply for the financial order. If there is an agreed financial settlement there is normally no need to attend a court hearing to get the order. If an agreement cannot be reached a financial application can be made. A family judge decides on what, in their view, is a fair financial settlement. Obtaining the financial court order before your divorce is finalised protects your interests.Evolve Family Law
